1. Service Description

EatryCloud is a cloud-based restaurant management platform that provides point-of-sale (POS), kitchen display system (KDS), inventory management, WhatsApp ordering, and payment processing services for restaurants in Ghana. By using our services, you agree to these terms.

2. Account Responsibilities

When you create an EatryCloud account, you agree to:

• Provide accurate and complete business and contact information
• Keep your login credentials and staff PINs secure
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access
• Ensure staff members are authorized to use the system on your behalf

3. Subscription and Payments

EatryCloud offers Starter (free) and Pro (paid) subscription tiers. By subscribing to a paid plan:

• You agree to pay the subscription fees as specified at the time of purchase
• Payments are processed in Ghana Cedis (GHS) through Paystack
• Subscriptions renew automatically unless cancelled before the renewal date
• New accounts receive a 14-day Pro trial at no cost
• Downgrades to the Starter tier may result in loss of access to Pro features

4. Payment Processing

EatryCloud facilitates mobile money and card payments between your customers and your restaurant through Paystack. We are not a payment processor. All payments are subject to Paystack's terms of service and applicable mobile money provider terms. Amounts are processed in Ghana Cedis (GHS).

5. WhatsApp Ordering

Our WhatsApp ordering feature allows your customers to place orders via WhatsApp. By enabling this feature:

• You consent to customer interactions being processed through Meta's WhatsApp Business API
• You are responsible for ensuring your menu and pricing are accurate
• Customer phone numbers and order data are stored to process and fulfill orders
• WhatsApp messaging is subject to Meta's Terms of Service

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the service
• Send spam or unsolicited messages through the WhatsApp ordering feature
• Resell or redistribute the service without authorization

7. Limitation of Liability

EatryCloud is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to loss of revenue, data, or business opportunities.

8. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these terms or fail to pay subscription fees. Upon termination, your access to the service will cease, but we may retain certain data as required by law.

9. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or through the platform. Continued use of the service after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved in the courts of Ghana.
